On August 2, 2023, my wife visited the office to submit a 30-day notice of our intention to move out to the landlord. She was provided with a form to be completed by the head of the household, which is me. During her visit, she inquired about the possibility of selling our membership and transferring our unit to someone else. However, the office informed her that such a transaction was not possible.
On August 3, I personally went to the office with the signed notice and posed the same question about selling our membership. I received the same response – it was not allowed. To corroborate this information, I sent a friend as a witness, and he also received the same answer.
In the last week of August, I provided the landlord with our forwarding address and requested assistance for a moving-out inspection. The manager informed me that they no longer conduct inspections due to COVID but assured me that they would accompany me once I was ready.
On August 31, I returned to the office to arrange for the inspection and hand over the keys. However, they stated that no one could accompany me at that moment but promised to call me later. Despite waiting for a call until September 5, I received none. When I returned to the office, they informed me that they had conducted the inspection on August 31 and that it was now too late as they were already working on the apartment.
On October 5, I received a notice from the post office regarding certified mail from the landlord, collected on October 6. The notice was dated October 2 and mailed on the same day. Reflecting on the terms of our agreement, I believe the landlord breached the agreement three times:
They failed to send the notice of the final account within the stipulated 30 days, as specified in lease clause 9.d, the Convention of Living Moving Out Policy clauses 4 and 8.
They denied my right to sell my membership, which could have benefited a family member or friend.
They did not allow me to attend the moving-out inspection, which would have enabled me to address any potential issues and avoid additional charges in a timely manner.
