  2. Refund $75 x2 = $150, Pet Deposit. Lease Breach of tenant rights (NMSA § 47-8-18(C)) no damage incurred by pets
  3. Refund of $800 rent for August that was prepaid. Entire month Apartment is Uninhabitable. Infested with Bed bugs.
  4. Refund Associated RPA fees.
  5. Reimburse moving costs associated with relocating due to Parasitic Infestation

COMPLAINT DETAILS (from renter)

We moved in about the 4th of May. there was many bugs in the apartment. I took a video of the apartment before we moved for record. some dead ones on the toilet seat and some in the cabinets. flies in the dishwasher where there was stagnant water from before. We didn\'t think much of it as bugs are all over the place. As we slept there night after night we started to itch and see small red bumps. We thought perhaps it was ants or a mosquito bite, weve had small ants bite before. maybe a week after we moved we found a small bug on the towels in the cabinet. Same place where in the video you can see a dead bug. I had never seen a bed bug. upon inspecting the small bug i assumed it was a tick! i have seen those before. and figure we did have cats. never had ticks before as they\'re indoor cats but its not unreasonable to speculate. After another week of itching we decided that there has to be some type of bug biting us. maybe an ant or some type of fly so we went to the store and bought some bug spray. but needless to say that got rid of the visible bugs but the bites kept happening! mostly to our 8 month old baby girl. a few more weeks went by and the bites weren\'t so bad but still happening. figured the spray was helping. until this last week. my wife is finally fed up seeing red bumps on our baby and worrying as a new mother if perhaps shes allergic to something or if its a rash..... she asked me to check the bed and house when i got home from work. i googled the bites and what it could be and i saw bed bugs, so i looked up what they look like and began looking with a flashlight. sure enough I found a few single bed bugs on the bed. Full grown adults big enough to see with the naked eye. After searching further there were more the 100+ fully grown adult bed bugs on our bed clustered together on the seams in the back by the headboard. i know we didn\'t bring these. but questioned, could we have? we notified our landlord immediately and he had an exterminator out the next day. I contacted Terminex and asked how we could tell who introduced them, they said there\'s no knowing but a sure sign is a lot of adults. They explained, a bed bug cannot reproduce or lay eggs until it is 35 days old and at that point they just lay the eggs. it would take another 7 days for them to hatch and even then they wouldn\'t be visible for another 3 weeks. With this many adults it is impossible for them to have bred in the time we were there assuming we brought them with the move.
