Carriage Place rented us an apartment that was unlivable. We had to clean scum from the entire apartment, and we took photos and notified management. The handrails to the stairs were loose and doors were falling off of the hinges. We placed a maintenance request, and were told by management that we were not a priority to fix these issues, even though my handicapped mother was visiting. Black water was coming out of our faucets, and we placed service requests and received no replies. Kristin left messages for Simpson Property and the Health Department and never received replies. Kristin spoke with Michelle and expressed concern for their health and safety because she and John are trying to conceive. Michelle stated that she did not know when this could be fixed. She offered to let us out of our lease because of all of the issues we were having. Fortunately, the water heater was replaced and this fixed the issue. Then the dishwasher was not draining and it started to smell up the apartment with stale water and bacteria. The dishwasher was never fixed nor replaced, even after several service requests going on for months. Michelle offered again to break the lease with no penalties due to the condition of the apartment. We took this offer and cleaned the apartment, including having professional carpet cleaners arrive the day before our move-out inspection. Katelyn Wade performed our move-out inspection, stating that the apartment was “pristine.” We all signed a move-out inspection form stating that the apartment was in good condition, and she stated we would receive our security deposit back. We then received a letter from Katelyn stating that due to heavy pet urine throughout the home, the carpets had to be replaced. They are taking our deposits in the amount of $600.00 and charging us an additional $1000.77 and threatening to ruin our credit. We have officially disputed this charge because the apartment was not habitable for months, and because our cat was not allowed in the entire home. According to Colorado law, we could counter Carriage Place under statute §38-12-501 through 511 for failure to repair and maintain the rental, as well as failure to maintain a habitable premises by not fixing plumbing in a timely manner, not keeping stairways and railings maintained and in good repair, and other recorded issues. Our counter-offer is to allow Carriage Place to keep our deposits to replace the carpet in the second bedroom with no further charges.
