There have been 3 noise incidents/complaints against us. The 1st and 3rd were filed with our landlord. We have provided thorough and explicit documentation to our landlord regarding all issues. As of our last notification, we are facing consequence if a 3rd unjust noise complaint is filed.
We do not like being under constant scrutiny, state of worry, and we do not feel as though we are able to rightfully use our property because of unjust complaints. We do not want problems with our neighbors.
We know that our neighbors’ unjust complaints can impact our residency and we feel defenseless. They also scare us because we have heard violent smashing sounds and the screaming of vulgarities from their apartment below. At that time we locked our doors and stayed put so no one knew we were home. Regardless, we know that the tenant below is ex-army and his strength, temper, and unreasonable attitude worries us.
Brief overview of incidences:
Incident 1/complaint 1- There was 1 guest. We returned home around 2am. After a brief chat on the front porch (farthest from their bedroom) we went inside and chatted. We used our refrigerator/bathroom. The core complaint was “banging” sounds. We apologized in good faith, offered a gift, and tried to resolve the issue but had no cooperation from our 1st floor neighbors.
Incident 2- There were 2 guests. After going out, they took their keys and left around 1:30am. For the duration of the night there was no activity other than refrigerator and bathroom use. The next day, our 1st floor neighbors complained to me via text. I politely explained that we hadn’t made noise, and asked for details so we could figure out the problem. They refused cooperation. I notified my landlord that there is an issue but received another complaint before providing him the details.
Incident 3/complaint 2- There was 1 guest. We did nothing besides hang out and use the refrigerator/bathroom. There was no other activity. We received a complaint and notice that a 3rd official complaint would result in consequence.
Because we know that there is no basis for these complaints, we are constantly on edge. There are no further accommodations we can reasonably make either.
Accommodations include but are not limited to: taking our shoes off before walking up to our second floor apartment, not closing our bathroom door, not exiting or entering as we please, not showering when we please, tip-toeing, etc.(more accommodations are listed in supporting documen
