This morning I was contacted by my former landlord stating that our security deposit would not be returned to us due to a 'hole in the wall' and 'trash in the attic'. I explained to my landlord that the hole was patched up and I had been waiting for her return correspondance on excess paint that they may have to completely fix the wall. I also explained that one of my roommates redid her room, removing the old wallpaper and priming and painting the walls multiple times, due to what appears to be horsehair walls. All three of us worked hard to complete her room while the room resider incurred a large expense to complete this project. We did let our landlords know of our plan, which they gave permission to execute, but provided no compensation or lease break in return for improving their property. My former landlord also brought up the fact that there was trash left in the attic. This trash does not belong to any tenants on the most recent lease and is from previous tenants who have since moved out. Upon these tenants leaving after their year had expired and they decided to no resign I contacted the landlords explaining that they had left a mess, as to communicate that it was not our responsibility to remove their mess. Lastly, we had cleaned the apartment to the level of condition that it was given to us in. Our former landlord also threatened to take us to small claims court due to us not having been completely moved out by the 2nd, which was our agreement. This happened only due to our new apartment being occupied and out move-in date and time being pushed back multiple times, leaving us in a bind. Based on all of the facts provided, we do not feel that our former landlords have sufficient justification to keep our deposit. We have been fair and cordial throughout our lease and feel extremely taken of advantage of.
