I was not in U.S. yet when renting the studio about three weeks ago. I found on the website of Crestview that their apartments are “quite, clean and close to campus” and there are some pictures of the building and the sample studio. I rented the studio based on such information quickly. In the renting process, the staff of Crestview did not inform me the specific location and orientation of the studio. I signed the contract based on the limited information.
On 8 August 2013 when I arrived at my studio, I found that it is less than 10 meters away from the highway, the door and the window are facing to the highway, and they are not soundproffing. Therefore, there is excessive traffic noise even during midnight. I was barely able to sleep in the night because of that. On the next day, 9 August 2013, I went to the Crestview office to complain about this and requested to cancel the contract or switch the apartment. The Crestview staff told me it is impossible to cancel the contract since I have signed it for one year, don’t have studios available in the other side of the building which is opposite to the highway, and have only one apartment available which is facing and close to the highway as well. I called back on 10 August 2013 that I don’t want that apartment either since it is still noisy. Then the person who answered my phone told me that the last option is to sublease the studio and one-month rent will be charged based on the condition that it is my responsibility to sublease.
I don’t think it is fair. I believe that I would not sign the lease contract if I was informed about the important fact that the studio is too noisy due to its location and orientation. I think it is the responsibility of Crestview to sublease the studio to someone else who does not care much about the noise without any charge on me to compensate this.
