COMPLAINT DETAILS (from renter) |
We signed a one year lease with Park Villa on Saturday. Discovered and overflowing toilet and bathtub. We Had to stop moving into the apartment for fear of water damage or sewage smell. On Sunday, we returned to the apartment to find everything had worsened. The bathroom, bedroom, and closet floor were soaked with toilet water. I, Mary Catherine Procell, called the landlord to verbally terminate our lease. According to the lease, under "Delay of Occupancy," I was well within my rights to request a lease termination and in return get our rent back. The landlord and property manager both refuse to honor this. They refuse to agree to a lease termination. I sent a written notice of termination first thing Monday morning. They continue to tell me "He is an attorney and he will not let you do that." (Neither managers told me who "he" was but I assume this gentleman owns the property). All I require is cooperation but instead I've spoken with two separate attorneys and may be forced to sue. I have pictures. I understand the delayed occupancy termination requirements.
