Was charged $450 for a crack in the shower surround "cultured marble" that was not even noticed until final move out inspection, this damage was not caused by myself or my 9 year old son, other areas in different units made of the same material have also cracked "counter tops" I was told by Kevin of Five star that this was caused by faulty materials, I asked "so why couldn't the same thing be happening with the shower surround?" I was told that because this is the first case of this happening with the shower it was my fault and happened on my watch so I am financially responsible. I asked for a copy of the pictures that were taken of the damage and was denied being told it was company property and they would not share them with me. The shower surround was so old Five Star that they could not find a match in material or color and they were going to to have to replace the whole shower. I believe this is a normal wear area and the materials were old and of low quality to begin with, causing the crack over time and with the presence of water and daily use of years of renters.

I am willing to provide the following resolution, a settlement of $100 roughly the cost of filing this claim, and that five star property management will provide information? • Type, grade, and quality of material that was replaced? This has allot to do with the expected life, if the surround was only 7 years old why was it impossible to replace with the exact quality grade and color? • The Type, grade and quality of material used in the new shower surround? • Provide documentation of repairs as requested and an explanation of why I was denied beforehand? • Pictures of the damage and explanation of why I was denied when they were requested the first time? • Explain the difference between the cultured marble used in the Showers and the cultured marble used on the countertops, if one cracks for no reason then why can’t another? • Does five star own this property or not I want to know if a conflict of interest playing a factor or not? • I want an apology for being wrongly accused of causing this damage and if need be would even submit to a polygraph to prove that I am being honest and forthright about this situation; I will even pay half of the expense? I want to state it’s the principal of being accused and treated like I am lying and trying to steal from five star property management and the underlying tone that I was dishonest, the manner in which I was treated initially is what has brought about this grievance. The shower surround is a highly used area and is subject to weight and flex by stepping in and out of the shower multiple times on a daily basis. The quality of materials being the key here, there is documented proof on the internet that the lowest quality cultured marble will only last 7-10 years and need replacement, an high quality material can last up to 25 years or more. Had I been given the documentation (invoice copies, photos or forms) up front and accurately informed of the damage repair cost and had been treated with professionalism and not accused and treated rudely, this would have been a very easy resolution. I would like to also add that five star also accused me of some minor damage to the siding near the garage door and accused me in the same manner until it was found to be documented in some of their older files prior to my moving in, I would like to know why that was not fixed when beforehand and why I was almost held responsible for this as well?

Explanation: I will fulfill the landlord request to stop any further negotiations if agreed to alternative resolution I feel this is fair and just.
