On July 1, 2011, the air conditioner in the rental unit stopped working. The landlord was informed of this problem and told I would not pay July rent until the air conditioner was fixed. No action was taken by the landlord and I suffered in 90+ degree temperatures for five (5) days. On July 5, the air conditiner was eventually fixed and July rent was paid by me. The landlord is now sending threatening letters stating a late fee of $70.50 is due, and I will be evicted unless it is paid. Since the rental unit was uninhabitable for 5 days because of the heat,, and the landlord refused to make repairs, in a timely manner, the landlord is in breach of the rental agreement.
