COMPLAINT DETAILS (from renter) |
On October 15th, 2010 I put a deposit down on this rental for the landlord to start making up the rental agreement. I was suppose to move in on November 8th, 2010. There is currently a renter in the house until November 8th, 2010. I found out on October 29th, 2010 that I was going to Missouri to work for three months or more. On October 31st, 2010 I called and left the Landlord a message letting him know that I was not going to be able to rent the house out from him. On November 1st, 2010 the landlord returned my phone call, and said that he got the message that I left him. He said that he would try to work with me, by maybe dopping the rent while I was working out of town, but he had to look at his financial situation, and talk to his wife. Later that same day I called him back to see if he would drop the rent, he said that he couldn't drop the rent. I told him that I would have to think about it over night, and I would get back to him. The next morning November 2nd, 2010 I called him to let him know that I will not be renting his house from him, he then became very angry, and told me that he lost a bunch of money by taking the house off the market, and now he has to put the house back on the market to re-rent it. He then told me that I was not going to get my deposit back, because of those reasons. He then told me that he has been a landlord for a long time and that is how it works. I told him that I wanted my deposit back, and he said I am not giving it back and that he would be willing to justify it in a court of law, then I said, ok, I guess I will see you in court. Then he hung up the phone.
I did not sign a rental agreement on this house. I have a reciept that is signed by the landlord to prove that I gave him the deposit of $650.
