Who is responsible for repairs?

Both the landlord and the tenant must be responsible to make certain and maintain a rental unit to be habitable and in good condition to future renters. Although landlords must be held responsible for guaranteeing that his rental unity is fit for humans.
Here is a list of the repairs a landlord must make.
- Maintenance. Since the landlord is the owner of the rental unit then he has the responsibility for maintaining the condition of the house/ apartment for as long as the damages were not done by the tenant to make sure that the property is liveable.
- Repairs to make sure unit is habitable. Even though the rental unit was being rented by a tenant the landlord still has the responsibility to make sure that rental unit is safe, clean and sanitary for humans. This includes repairing conditions that extremely disturb the tenant’s human habitability.
Here are the kinds of repair a tenant must do.
- Damages caused by pets. Any damages that are done by the tenant’s pets must be repaired by the tenant himself and not the landlord. The lease agreement often times does not include repairing any damages made by the tenant, his pets or guests to be paid for by the landlord.
- Damages made during a fight. Broken windows or door jams caused by an extreme fight between the renters of the property or their children must be repaired by the renters. Or if they call someone to fix it, the renter is most likely the one responsible to pay for the repairman.
Once the determination of who caused the damages to the property was made, the repairs come after. If both parties refuse to pay for the repairs, then it becomes a big dispute between them that may sometimes lead to lawsuits filed by both of them to both of them.
