They are not giving my deposit back

I signed a lease on. Has the landlord hold it until we moved in a month later. Payed the deposit. Called the landlord about a week bfore we were supposed to move in to let them know that we were not moving in. They are keeping out deposit for charges incurred to them for keeping the property vacant and also because we did not given them a 30 day written notice. Is this a valid complaint that I should report my landlord for? We never moved in???
