Second time flooding in my daughters room at college…

My daughter is a college student and she lives in a house with her roommates.  Her bedroom has flooded twice in the last 6 month.  The first time, we replaced the carpet ourselves (it was our own) and the LL did the cleanup.  The damage was in her closet and throughtout the room etc.  We were okay with the job he did and he said the problem was fixed and it would not happen again.  The tenant that lived there prior to her said it had happened to her as well but only once in two years.  So it has happened again and she now has damage to expensive rugs that we put down as well as her dust ruffle and some furniture.  I’m also concerened about a mold problem.  Her room temperature also is very hot and it doesn’t seem to be controlled by the thermostat.  What are her rights with the damage done to her property (rugs, furniture, etc.) and does she have any compensation due her?  Thank you college student

Does she have renter’s insurance? Renter’s insurance covers for the damages to her personal belongings even if it was due to burst pipes or some problem with the plumbing. Her LL’s insurance will only cover the damages to the rental property. But since this has happened twice, then she can speak to her LL about a possible rent reduction. Do not withhold rent unless you go through the clerk of court. If the LL does not cooperate, you can file a complaint against him through the RPA.

You’re right, though, mold may start to develop due to constant exposure to water and moisture but if it develops really fast, it may not be the dreaded black mold. She can tell her LL about it and usually, it will only require a quick scraping and then cleaning of the surface affected by mold. Sounds like she needs to move out at the end of her lease…the many apartment problems may be distractions to her studies. Good luck!
