Problems with Landlord Repair…Like pulling teeth…
By Tyler Bell
So my wife and I live in the Biltmore Apartments in Omaha, NE. We were very happy when we moved in and honestly the management never have given us reason to be anything but happy.
It all started one day when we noticed a mold growing out through our tiles in the shower/bath tub. We thought it was just shower mildew but as time progressed it spead and turned black and started to discolor our tub. We cleaned and scrubbed to no avail, it always returned with a vengence. After a while the dry wall around the shower started to sag and be discolored with a rusty/black seepage. Not to mention our hot water stopped working only in the shower.
So what did we do?! We called our landlord! They sent a worker to our apartment who cut two decent sized holes in the dry wall told us that the entire shower wall needed to be replaced because there was a leak in the pipes and all the dry wall was rotting away. He told us that he would turn it in and it would be fixed. Approximately three whole months we waited for the fix-it-crew to show and fix our disgusting moldy shower. Nada. Nothing.
So we tried again, but this time I called the corporate phone number. They sent a different guy out who said the same thing and that this time they would actually fix it and that it would take 3-4 days and we would be given keys to a different apartment to shower in during that time. That was almost two weeks ago.
We were curious if this issue was happening with others in our complex and came to find out that our neighbor had a water leak in the wall by his closet where mold grew and his carpet turned into a stiff board. He told us that he fought for almost a whole year for them to fix it. It took him threatening them legally for them to fix it a year later.
There was also a water leak behind our wall in our bedroom where water was leaking out of a light switch socket…dangerous right? And when they came to check things out the first time and I told them about the leak they flushed the line on the air conditioner and told me that once it dried everything would be fine and that they would paint once we moved out.
My wife has upper respiratory problems and has sickle cell anemia on top of that. Because of the mold I worry for her. We feel stuck.
What are we to do? We don’t want to fight these guys for a whole year? Is there some violation being made here, health-code wise?
