Extremely noisy neighbors

We are renting a basement apartment and unfortunately we have  extremely noisy neighbors. We have lived here for 6 months and the first 4 months were great. The last 2 months have been hell. We have complained several times to the neighbors for noise reduction and they say they will be quite and they are for awhile. They are excessively noisy after 10pm some nights till 1:30 am. I work in a bakery and get up for work at 2:30 am, so needless to say I don’t get much sleep. Our 2 year old daughter wakes up scared and crying because of their noise.. When I say noise I mean slamming doors, stomping footsteps, pounding on floor, dragging things across floor, dropping heavy things, Having their grand kids and visitors over daily, all day and overnights.

We have written letters to the landlord, sent several email and txts and had many conversations. She did write them a letter and the upstair tenants lied about stuff and did agree to keep it down., but after a few weeks they are back at it.. When we talk to her about them and how when we talk to them now we get major attitude from the noisy  neighbors. She now says she doesn’t have their current cell phone numbers and asks us to get them or to tell them that she wants to talk to them. I did just that. I had the landlord on the phone and told the neighbors she wanted them to call her and of course they didn’t!

We also have our own personal washers and dryers. They are next to each other in a common foyer  area. The neighbors have been using our washer and dryer when we go out of town on the weekends. We have found clothes in there such as a sock left behind, or underwear..
What are our rights??? We can’t move for 2 more months..(schooling).. Can we withhold rent?? call the cops, or what..?? We live in Utah… please any advise would be great!!!!!

Amy,

I can understand how noisy environment it would be, Also they have provide you false commitment to you and also your landlord that they will be not make noise. They need to think more seriously about what major problem they are giving without having ashamed of himself that the guy wake up at 2.30 AM for bakery job purposes My opinion is to contact RPA (Rental protection agency) they are able to resolve the issue providing specific resolution also.

I suggest you check with a legal aid. This has caused too much aggrevation on your part. You can always ask help from those in authority. This could help in relieving your distress. Once you seek legal aid you maybe able to resolve your issues. You can also file a complaint here at RPA through http://www.rentalprotectionagency.com/complaint_center.php
