Noisy maintenance works and privacy breached

By JC

Hi:

I live in Cambridge, MA. The board of trustees of my building decided to start maintenance works to the building’s facade. Works start at 7:30 am, they are extremely noisy right outside our unit, they finished at 4:30 pm. Nopise is constant. I have to work at home and it is just impossible. According to info provided it will take around 3 weeks to finish! I definitely cannot live there and was wondering if there is anything I can do to either stop the works till I leave (June) or break the lease to move elsewhere without penalty (the contract says there will be a one month penalty and such).
Moreover, the landlord got into my apartment last week supposedly for safety concerns about the gas instalation but he was really looking for a dog inside my unit. A friend who was visiiting was at home and told them everything was OK, but they went back again when we were not there and now the landlord is threatening that he will make random checks! Can he do that? He is breaching my privacy.
We are talking of a $2,000 monthly rent so I wooudl expect privacy and quiet surroundings which I do not have.
What are my options? Thanks,
JC

This is clearly a case of constructive eviction. What this means in simple language is that your apartment is no longer suitable for the purpose it was rented, for your quiet enjoyment. You may break your lease even if property manegment does not agree as long as your willing to litigate you will win. Just make sure to document the conditions your living under.
