No lease, but accused of breaking lease.

In January of 2011 my teenage daughter and I moved into a studio apartment that was actually a coverted garage of someones for $650 a month, all inclusive.  I was going through a divorce and didn’t have alot of money.  We lived there until June 2012 under a years lease.  We moved out because my boyfriend and I decided we were stepping towards marriage and he was going to sea anyhow so he wouldn’t be around.  Two months later he go cold feet, so in August 2012 I contacted my old landlord, it had not been rented but she bumped it to $800.  I had no choice so we moved back in.  Our only "agreement" came in a form of a spreadsheet I sent her mapping out my payments for the next year so that I could pay half each paycheck because that was really alot of money for me.  She made some changes and that was all we said.  We didn’t write up a lease or anything.  My boyfriend and I continued to work through his anxieties and stuff, so in march of 2013 he proposed and we set the date for May 4, 2013.  I gave her two months notice paying through May 31, 2013.  Memorial day weekend we moved everything out, cleaned and I handed her the key.  She said it was all great and she would mail me the $800 deposit.  I gave her my new address.  This past Friday she FB messaged me that she forgot to mail out the check but would this next week.  Last night she texted me stating that her funds were tight but anyhow I was 2 months short of my years lease with her so I forfieted the deposit.  We DIDN’T have a lease, just a spreadsheet via email, not signatures.  Is this even legal.  By the way we are located in Virginia.  Thanks!
