Landlord is in foreclosure

By Pat Cromwell

My landlord has not made the mortgage payments.  I’ve received 2 foreclosure documents from the courts via mail addressd to Unknown Occupant.  The last payment the landlord made was Sept of 2009.  I spoke to the Property Mgt firm when I received the first set of legal documents.  The Property Mgt firm said not to worry — the owner was in the process of fixing the problem.  Well, now I’ve received the 2nd set of documents so Property Mgt firm was either not-truthful or are in the dark.

What are my rights as a tenant who has made payments religiously?  I’ve been in the house for 3 years now, never missed a payment.  BTW, in August I began to worry because my least expired on Aug 31.  Still no least.  I believe the correct term is that I am now on a month-2-month lease now.  I’ve tried to contact the Property Mgt firm  but all I get is voice mail.

Should I continue making my rent payment or should I put it in an account?  What is the process?  Will I have to move immediately if the sherrif post an eviction notice because the landlord is a year behind?  Was is legally okay for them to have me sign a least when the payments were not being made?  Should I contact the morgage company in advance and make arrangements to rent from them?  Is there a legal recourse for Renters in Indiana who are current with their payments but the landlord does not pay the morgage rsulting in foreclosure and eviction?

 Thanks!
