Landlord deducting excessive amount from security deposit

I lived in a small apartment complex in Pasadena CA for 3 years. After moving out the lender deducted large deposit and returned the money after more 35 DAYS. He deducted about $600 towards replace the carpet using a depreciation schedule of 20% a year ( when we left there was no damage except the normal wear and tear). He never disclosed the cost during the lease signup. Morever he never told us about the carpet replacement during the final walkthrough. on top of that he also charged $275 towards cleaning Also he deducted service call for electrical issue that was occurred many many months before we moved out. So he is putting all the expenses to our file with letting us know and when we left the apartment and is presenting this huge bill. I feel like this is not right.
Any advice ?

File small claims suit to claim your security deposit. You are entitled to ‘normal wear and tear’ on carpet, etc. He cant deduct 20% per year from your desposit because A. You dont know how MUCH he paid for the carpet when it was NEW, B. You dont know HOW NEW the carpet is. A price cannot be reasonably and fairly determined for the carpet. Cleaning costs of $275?. You must of trashed the place I think here in Ohio Landlords can only charge and tenant no more than $15 per hr for a professional cleaning service to clean. I might be wrong on the dollar amt might be higher or lower but its close!!. Do the math… |
