I live in an apartment and was recently asked by the landlord to help him by vacuuming the hallway because another tenant was going to be steam cleaning there apartment and he just wanted the hallway cleaned so they can steam the hall too.He did not tell me she had bedbugs and that was why this was being done. I have done this in the past for the landlord with a vacuum that I used for this purpose without any problems, but if I knew there was a bedbug problem I would never have used this vacuum or done the job period. Since doing this, now I am infested and now I have to throw out 2 queen sized beds and steam clean my apartment to almost guarantee the infestation will stop, at least for my place. Even the exterminator said that’s how I got them in my place.My question is, can I hold the landlord responsible for the replacement of my beds and the steam cleaning, or can he make me pay for it all. I live in illinois and I would appreciate to hear from anyone with legal knowledge, but any input will be helpful. thank you

According to the Illinois Department of Public Health, landlords are responsible for the contracting and coordinating of bed bug control in all apartment units. So they wouold spend on the bedbug treatment. Your lease agreement may say otherwise but always remember that the state laws supersede your lease agreement. With regard to the furniture replacement, the State of Illinois does not have any provisions for that. But you can talk to your landlord about it. If you were to pursue this in court, you will need to have extensive documentation and proof. You may start your paper trail by filing a complaint with the RPA. |
