We received an 90 eviction notice

In December of 2009 my roof started leaking, and my floor was caving in. We asked the landlord to repair the problems. He told us that we had to do it our selve’s. We informed him that it was his responsibility to do so. time passed and we received an 90 eviction notice. We called him to ask why was we getting evicted in which we pay our rent on time every month which was a month to month agreement. He told us in order to honor our request for repairs, we would have to get out. He then offered us to move into another one of his properties in which was alot more than what we were paying. He had been trying to raise our rent for some time, but could not because we were grandfather in when he bought the property. We asked him again if we could stay, he stood firm on his eviction, which was March 1,2010. So we moved out on February 1,2010. Now he is suing for the month of February, the same month we moved out of his property, and he never gave us back our security deposit.
