MY NAME IS SAM THOMAS JR., AGE 46 DISABLED, DIABETIC WITH BREATHING
PROBLEMS JUST FOR STARTERS. PHONE NUMBER
IN DECEMBER 2009, I RECENTLY SEARCHED CRAIG’S LIST TO FIND
RESIDENCY AND RAN ACROSS THIS AD. $300 DEPOSIT GET REST OF
DECEMBER’S RENT FREE.”NEWLY RENOVATED 2 BDR APT $500.00 A MONTH WASHER N DRYER
INCLUDED”. NOTE: 12-14-2009
IT WAS WITHIN MY BUDGET AND NOT MY FAV PART OF JACKSON. I
GOOGLED IT FOR DIRECTIONS, THEN PROCEEDED TO DRIVE THROUGH THE NEIGHBORHOOD AT NIGHT TO
GET A BETTER VISUAL. TO MY SATISFACTION THE POLICE PRESENCE AND BURGLAR BARS ON THE APT
MADE IT “A NICE DEAL”
I CALLED THE NUMBER LISTED ON CRAIG’S LIST AND MET THE OWNER,
MS. SHENARA ANTHONY, SHE WAS VERY PLEASANT AND SEEMED AT THAT
TIME HONEST AND VERY SINCERE.

I MADE ARRANGEMENTS TO GO OVER TO VIEW THE INSIDE OF THE “NEW
RENOVATED APTS”, AND TAKE HER UP ON THE NO RENT FOR DEC. “$300
DEPOSIT MOVE-IN SPECIAL”!
PAY DEP., SIGN THE LEASE, AND RECIEVE MY KEYS, AND BEGIN MY LONG AWAITING MOVE…”

WHEN I MET HER TO VIEW THE APARTMENT, I ASKED DARYL, A PERSONAL CARE PERSON OF MINE, TO GO UPSTAIRS, BECAUSE MY FOOT WAS SWOLLEN ON THAT DAY. HE SAID / THAT THE APARTMNENT WOULD BE NICE FOR ME, BUT IT HAD A FEW REPAIRS THAT NEEDED TO BE ADDRESSED.
SHE INSURED US THAT SHE ONE OF HER GOALS WOULD BE TO INSURE THAT I WOULD BE COMFORTABLE.
BECAUSE SHE WANTED HER TENANTS TO FEEL AT HOME.
SHE INFORMED ME THAT THE POWER TO THE APARTMENT WASN’T TURNED ON
DUE TO THE BUILDING BEING VACANT FOR SO LONG, AND IT WAS THE
TENANTS RESPONSIILITY TO CONTACT ENTERGY FOR ELECTRICAL UTILITIES.
SHE INFORMED ME THAT ABSOLUTELY NO APPLIANCES WOULD BE INSTALLED UNTIL UNITS WERE RENTED BY TENANTS. SHE INFORMED ME THAT EACH TENANT IN THE QUAD PLEX ARE RESPONSIBLE FOR ELECTRICITY AND WATER UTILITIES. THIS WAS STANDARD SO I AGREED.
SHE NEEDED A COPY OF MY ID, PROOF OF INCOME, AND A $30
APPLICATION FEE WITH THE $300.00 SPECIFIED IN AD DEC’S RENT
SPECIAL…ON CRAIG’S LIST.
I SUPPLIED HER A COPY OF ALL ITEMS LISTED ABOVE TO INIATE THE
APARTMENT RENTAL / CRIMINAL BACK GROUND CHECK APPROVAL PROCESS. ALONG WITH MY $30 APPLICATION FEE.
WE FOLLOWED HER TO THE WALGREEN PARKING LOT AND FILLED/SIGNED AND MAKE COPIES OF OUR NEW AGREEMENT.
I FELT TO MY BEST INTEREST TO ASK FOR A COPY OF HER ID. JUST TO
ENSURE I WASN’T BEING SCAMMED.
MY GUT FEELING TOLD ME “THIS SETUP ISN’T HOW, A PROFESSIONAL
LANDLORD, OR EVEN A AMATEUR LEASING AGENT, SUPPOSED TO RENT OUT AN APARTMENT…IT’S COLD, DARK, AND RAINING THAT NIGHT, THE APT WAS AND IS CLEARLY VACANT AND NOONE LIVING
THERE CURRENTLY!
WHEN WE ARRIVED AT WALGREEN, OFF OF NORTHSIDE DRIVE, THEY DIDN’T HAVE A COPIER SERVICE,
WE AGREED TO MEET AT OFFICE DEPOT OFF I-55 TO RESUME OUR LEASE SIGNING. I PAID $300.00
AND SIGNED THE LEASING AGREEMENT.
THE VERY NEXT DAY SHE INFORMED ME I HAD BEEN APPROVED AND I MET
HER OVER TO THE APARTMENT TO RECIEVE THE KEYS. AND WAS TOLD I
COULD START MOVING AND LIVING IN MY NEW APARTMENT.
I ONLY MOVED MY FURNITURE, CLOTHES, TV’S LAMPS ETC… INTO THE APT BUT DIDNT PHYSICALLY
MOVE IN MYSELF, DUE TO NO ELECRICITY OR WATER IN OPERATION.
AND I PROMISED AFTER CHRISTMAS HOLIDAY I WOULD DRIVE MY NEPHEWS BACK HOME TO ATLANTA TO
START SCHOOL IN TIME.
BEFORE I LEFT, I WAS CALLED BY MISS ANTHONY ASKING DID I OR SOMEONE LIVING IN MY
APARTMENT LEAVE A CANDLE OR SUMTHIN LIT, BECAUSE IT WAS REPORTED TO HER “MY UNIT WAS
SMOKING”!
I CALLED 911 AFRAID FOR ALL MY THINGS, TO INFORM THEM OF THIS MATTER AND I LET HER KNOW
BECAUSE OF THE HEALTH RISK NO
WATER OR ELECTRICITY I HADN’T ACTUALLY BEGAN LIVING IN THE UNIT.
911 RESPONDED AND TOLD ME THEY HAD JUST LEFT FROM THE BUILDING
AND THE FIRE HAD BEEN CONTAINED.
PROBABLE CAUSE AT THAT TIME UNKNOWN. MISS ANTHONY WAS TOLD
IMEDIATELY AND TOLD ME IT WAS A MAINTAINANCE MAN WORKING ON A
PROJECT UPGRADING THE HEAT/AIR CONDITIONING INSTALLATION
DOWNSTAIRS CAUSED THIS DAMAGE. (SEE FIRE DEPT’S RECORD FOR EXACT
DATE)
I REQUESTED SOMETHING BE DONE ABOUT THE SMOKE IN MY APT AND ASK
WAS THE PROPERTY SAFE. IT WAS TOLD ME THAT WASN’T GOING TO
HAPPEN AGAIN AND I SHOULDN’T WORRY, SHE WOULD DO ALL SHE COULD
TO ENSURE MY SAFETY AND THAT I WOULD BE COMFORTABLE.
AFTER CONTACTING ENTERGY FOR MY ELECTRICITY I WAS NOTIFIED THAT
THE LIGHTS WERE ON AND NEEDED TO BE TRANSFERED TO MY NAME. BY
MISS ANTHONY, NOT TRUE.
ENTERGY IN FACT CAME OUT AND HAD TO REPLACE WIRES CONNECTED TO
THE BUILDING, AND REPORTED THE BUILDING ITSELF HAD WIRING ISSUES
NOT REGULATED BY THE STATE OR ENTERGY.
EXAMPLE. SLOT FOR METER #1-APT B ACTUALLY CUTS ON APT-C
SLOT FOR METER #2-APT A ACTUALLY CUTS ON APT-B…ETC.
ENTERGYWAS CALLED AND THIS ISSUE WAS FINALIZED. DUE TO THE
HOLIDAYS, AND JACKSON, MS. WATER MAIN BREAKS NEW WATER TURN-ONS
TOOK BACK STAGE. AFTER THIS CRISIS LIFTED CITY OF JACKSON CAME OUT TO INSTALL A WATER
METER AND TURN ON THE WATER IN MY
APARTMENT. ONLY TO REJECT MY ORDER DUE TO FAULTY PIPING THAT
CAUSED WATER GOING TO APT B TO FLOOD THE DOWNSTAIRS UNIT.
THEY REPORTED THAT WATER COULDNOT BE TURNED ON NO PRESSURE, AND
FLOODING OF THE DOWNSTAIR APT WERE ALL NOT UP TO CODE, AND
PROPER PERMITS AND INSPECTIONS HAVE TO FOLLOW GUIDE LINES BEFORE
WATER WAS TO BE TURNED ON IN THE UNIT REQUESTING SERVICES.
I IMMEDIATELY CALLED MISS ANTHONY TO COMPLAIN AND GET THIS ISSUE
TAKEN CARE OF ASAP. SHE SAID SHE WOULD CALL THE PLUMBERS AND GET
RIGHT ON IT. MEANWHILE, WATER CRISIS IS TURNING BACK TO NORMAL
FOR MOST MY NIGHTMARE HAD JUST BEGAN… I ASK MY NEIGHBOR IN
APT. A TO FILL UP BUCKETS TUBS N GALLON JUGS WITH WATER TO WASH,
FLUSH THE TOILET, AND BOIL TO CLEAN FOR A PERIOD OF 21 DAYS.
CALLING MISS ANTHONY EVERY WEEK JUST TO SEE THE PROGRESS OF THE
FIXING OF MY PIPES. MONDAY, JAN 18TH WAS MLK HOLIDAY, SO I
WAITED TIL TUESDAY, JAN. 19TH AND CALLED MISS ANTHONY, SHE
EXPRESSED THAT THE PLUMBER WOULD COME OVER AS SOON AS HE GOT OFF
FROM HIS “FIRST” JOB…
WHEN HE ARRIVED, I NOTICED IT WAS THE SAME MAN WHO HAD INSTALLED
THE HEATING & AIR-CONDITIONING UNITS IN MY APT. HE TURNED ON THE
WATER, TO TRY AND FIND A SOLUTION.
HE STATED THAT THERE WERE ISSUES AND PIPES NEEDED TO BE
INSTALLED THAT WERE UNDERGROUND AND IN THE WALL, AND THAT HE
COULDN’T DO IT BECAUSE HE DIDN’T HAVE THE CORRECT TOOLS, AND HE
WOULD HAVE TO COME BACK WHEN HE COULD EARLIEST TIME WOULD BE
SATURDAY, JAN 23. TO FIX IT.
WEDNESDAY, JAN. 20, 201O FROM MY CELL I TEXTED
MISS ANTHONY TO INFORMED HER OF MY NECCESITY TO USE THE BATHROOM! I NEEDED TO BATHE,
WASH CLOTHES, CLEAN UP THE SMOKE DAMAGE APT LEFT FROM THE FIRST INCIDENT AT THE SAME
APT. AND SHE NEEDED TO GET SOMEONE OVER HERE SOONER THAN

SHE TEXTED BACK “LET ME CALL HIM NOW”
I CALLED HER BACK TO ASK HER HIS RESPONSE, AND WAS TOLD HE WOULD BE OVER IN THE MORNING. JAN. 21, 2010.

AFTER HE ARRIVED AND THOROUGHLY INVESTIGATED THE JOB AT HAND, HE DETERMINED IT WAS A JOB
THAT WOULD REQUIRE OLD FLOORING TO BE PULLED UP AND REPLACED, WALLS TO BE TORNED DOWN,
WELDING, AND NEW PLUMBING.
HE AT THAT TIME SAID WAS A MAJOR JOB. AND I WOULDNT HAVE WATER EVEN AFTER HE DID IT
BECAUSE THE CITY OF JACKSON, WOULD HAVE TO COME OUT AND ISSUE A PERMIT AND INSPECT THE
JOB AFTER MISS ANTHONY RE APPLIED WITH THE PROPER BUILDING CODES AND ETC.
I CALLED AND INFORMED MISS ANTHONY OF MY DISSATISFIED THOUGHT OF NO WATER SINCE I MOVED,
AND THE POSSIBILITY OF NOT HAVING WATER IN MY “ALLEDGED NEWLY RENOVATED APT” SHE
PREVIOUSLY ADVERTISED ON CRAIGS LIST. SHE SAID SHE WOULD LOOK INTO IT AND CALLED ME
BACK TO SAY EVERYTHING WOULD BE RESOLVED TOMMOROW JUST BE A LITTLE PATIENT WITH HER.
AFTER 3PM AND HE WOULD RETURN TO FINISH THE REQUIRED REPAIRS, AND ALL WOULD BE WELL…
FRIDAY JAN.22,2010 THE MAN RETURNED, AND STARTED BANGING AND BUSTING THE FLOORS IN MY
APARTMENE, THE CEILING IN THE APARTMENT BELOW, AROUND 2:30 PM A STRANGE WHITE STRONG
SMELLING FOG STARTED TO FILL MY APT, MAKING IT UNBEARABLE TO BREATHE, DARYL RETURNED TO
SEE AND INFORMED ME, THAT MAN WAS DOWNSTAIRS WORKING AGAIN, “I SAW HIM WELDING SUMTHIN”
DARYL STATED. AND THE PROPPED THE DOOR ON AND CUT ON THE CENTRAL AIR, TO HELP WITH
BREATHING IN THESE UNIDENTIFIED FUMES.
I TEXTED MISS ANTHONY TO KEEP HER UPDATED AND REPORTED THE SMELLY FUMES, SHE REPLIED,
I’M HERE WITH HIM NOW.
AFTER BOUT AN HOUR THE SMELLY FUMES TURNED THICKENED AND BOTH MISS ANTHONY AND THE MAN
DOING THE WORK HAD BOTH LOCKED DOWNSTAIRS APT AND LEFT THE PROPERTY.
I NOTICED MY EYES BURNING AND MY SKINNED STARTED ITCHING MORE THAN THE NORM..I ASK DARYL
SDID HE NOW SMELL SMOKE AND TO INVESTIGATE, WHILE I CALLED MISS ANTHONY ON THE
PHONE…WHILE ON THE PHONE DARYL CAME INTO THE BEDROOM AND SAID THAT THERE WAS A HOLE IN
THE FLOOR HE SAID, HE IMAGINED THAT THE HOLE WAS THE NEW WAY TO GET WATER TO MY
APARTMENT. AND THAT SMOKE WAS COMING FROM THE HOLE.
MS. ANTHONY CALLED ME BACK, AND I BEGAN TO TELL HER HOW AWEFUL THIS SMELL WAS AND THAT
IT WAS DAMAGING MY FURNITURE AND CLOTHES AND A EVENING GOWN I WAS HEMING FOR A CLIENT. I
ASKED IF SHE COULD BRING FANS, OR ANY SOLUTION TO ASSIST, SHE REPLIED WELL CAN’T YOU
OPEN A WINDOW OR SOMETHING, I’M ON MY WAY BACK OVER THERE TO MEET THE MAN WORKING
DOWNSTAIRS HE HAD TO GO AND RUN AN ERRAND…
AFTER THE CALL ENDED DARYL WHILE IRONING HIS PANTS, NOTICED SEVERE AND HEAVY SMOKE AND
SCREAMED “SAM GET OUT THIS APARTMENT IS ON FIRE!!!” THATS NOT FUMES ITS SMOKING CUZ
DOWNSTAIRS ON FIRE!!!
I WEIGHT ALMOST 500 POUNDS AND WASNT PREPARED TO EVALCUATE SO SUDDENLY, MY HEART STARTED
TO BEAT REALLY FAST OF FEAR FOR MY LIFE,IN DISBELIEF I GRABBED MY CANE AND BEGAN FOR THE
DOOR, WHEN I GOT OUTSIDE I YELLED SOMEONE CALL 911, I WAS AFRAID AND ANGRY AT THE SAME
TIME, BEFORE I KNEW IT I CALLED MISS ANTHONY AND YELLED YOU TOLD ME TO OPEN A D**
WINDOW!!! THIS D** APRTMENT IS ON FIRE!!!
MY SKIN WAS SO IMFLAMMED AND ITCHING!!! I COULDNT CATCH MY BREATHE I COULD ONLY CALLAPSE
ON THE BACK SEAT OF JESSE ADDISON, SUV THAT WAS PARKED IN THE PARKING LOT OUTSIDE THE
APARTMENTS. THE FIRE DEPT AND PARMEDICS ARRIVED…EVERYTHING ELSE REALLY BLURRY, TIL I
GOT MY BREATHE BACK, THE PARMEDICS GAVE ME OXYGEN KEPT SAYING THINGS TO ME UNTIL A
STRETCHER LARGE ENOUGH COULD TRANSPORT ME TO THE HOSPITAL. DARYL ALSO HAD TO BE TREATED
WITH OXYGEN AND ETC…
I WAS TREATED AT THE MISSISSIPPI BAPTIST [601-968-100] HOSPITAL’S ER AND RELEASED TO THE
CARE OF MY DOCTOR ANDREA MORGAN. [601-815-5700]
WHEN ASKED WHO WAS MY INSURANCE CARRIERS I STATED, I’M NOT PAYING FOR THIS MISS
ANTHONY’S NEGLECT IS RESPONSIBLE!!!!
WHO’S ACCOUNTABLE???
WHILE IN THE HOSPITAL MISS ANTHONY, SEEMED CARING CONCERNED FOR MY WELL BEING TEXTED MY
CELL ASKING “WAS I OK”…I REPLIED I’M A LITTLE BETTER” AS SOON AS THEY RELEASED ME I
WILL INFORM HER, AND THAT MISSISSIPPI’S RED CROSS HAD CAME TO MY RESCUE AND TAKEN ME TO
A HOTEL, BOUGHT FOOD, HELP WITH SOME CLOTHING AND ETC.
AND I FIIGURED WITH ALL THAT I HAVE ENDURED TO ASK ANTHONY, “DID HE AT LEAST GET THE
WATER ON…?” THE REPLY WAS VERY UNEXPECTED!!!! AND I AM GUESSING UNLAWFUL!!!1
SHE TEXTED HER REPLY “NO UNFORTUNATELY THE FIRE DEPT HAS DEEMED THAT SAME APT UNLIVABLE
AND THAT I THE HAD TO VACATE IN 10 DAYS.
THE PROBLEMS IN ORDER TO FIX COMPLETELY WALLS WILL HAVE TO BE BROKEN DOWN AND PIPES ALL
REPLACED AND TO SAY I’M SORRY :-(”

DAYS YOU MUST VACATE…
HOPWA HAS PAID MY RENT FOR DEC, JAN, I HAVE MY RECIEPTS, TO WHOM IT MAY CONCERN, IM
BEING THROWN OUT OF AN APT, THATS NOT LIVABLE TORMENTED, AND HARRASSED TO VACATE WITHOUT
REIMBURSTMENT OF MY THINGS, REFUNDING OF ALL MNONIES PAID, AND ONLY TEN DAYS BEFORE SHE
TAKES MATTERS INTO HER OWN HAND…THIS ISNT THE LAW PLEASE HELP ME!!! THIS IS AN
UNLAWFUL EVICTION COMPLAINT, AND A HEALTH RISSK RENTERS NEED TO BE AWARE OF!!!

Wow! Quite the story. I wouldn’t worry about the medical bills too much. Your landlord should have an insurance policy that covers you and your departure. I would demand that the landlord provide you with the insurance details in order for you to get immediate assistance. If there is a problem, contact an attorney– they love these kind of cases. You should probably file a complaint with the RPA too. Hope you feel better! Shellie |
