Contact landlord…?

My name is Joshua M. and I have been renting an apartment for 6 months. Several things have broken or been in bad shape in the apartment and have had to be repaired. Any time I report something to my landlord, I am met with scornful remarks, or statements implying I am intentionally breaking things because “it was fine when I moved in, and no one else in the building calls the landlord to complain.”  Should I really fear contact with my landlord.  Isn’t it my right to contact landlord whenever and however I want as long as it is reasonable?
Our neighbors are noisy all day long, to the point where we can feel the bass from their stereo through the floor and they live 2 floors down from us. Our dishwasher runs, but that is about it. Our landlord claims if it runs, he has to do nothing else with it, even if it doesn’t clean the dishes. He blames it on hard water, but we have tried everything to get it to work. Recently something got stuck in the garbage disposal and he is saying we have to pay for all repairs.

He also constantly threatens to evict us because our floors aren’t always vacuumed and has string or bits of paper on the floor here or there. I feel pushed to not reveal other things that are wrong with the apartment or things that a decent landlord will fix, because he constantly implies I am breaking things.

We are completely fed up with his behavior but fear we have no way out. We are trying to get a copy of the rental agreement, but I am even afraid to deal with him to get that. As soon as I brought up the subject of wanting to be out of the lease, he began threatening to come over and start adding up “the damage” I have done to the apartment, even though there is nothing wrong with it.
About 6 weeks ago our garbage disposal got something caught in it. After telling the landlord about it, he threatened that i had to pay for it because “we broke it”. Even after saying that, I just said I don’t care, just fix it. It is now almost 2 months later and it still isn’t fixed. He put off coming over for weeks and weeks because he owns a flooring business and he considers that more important than his rentals. It has still been 2 weeks since then, when he said “I got a guy that will fix it”.
It is a never ending issues with him. I have been 2 days late with the rent 1 time, but since then I have not been late at all. I still haven’t gotten a copy of the rental agreement either. I misplaced mine and asked for a copy, been 2 weeks and still no lease. He won’t do anything unless I call and bother him 24/7 and after I have, he threatens me with eviction with whatever he can.

Any advice or information that may help me would be appreciated.

Joshua this is a common problem we see a lot. Your landlord is required to fix things when they break, unless it is due to neglect or mis-treatment by the renter. For example with your garbage disposal if it just stopped working, your landlord would need to fix it in a timely manner. However, if you turned on the disposal and accidentally had a metal utensil in the unit that tore up the teeth and burned out the motor, you would be responsible to fix it. Although, it may have been an accident, it is would be considered neglect since you could have prevented it from happening, I.E. immediately turning off the unit and pulling the utensil out. This is just an example, since I don’t actually know the circumstances surrounding its demise.

As for the landlord telling you that you keep breaking things, well, does he have any proof or is he just trying to get you paranoid so that you won’t keep calling him? Not all repairs are the responsibility of the landlord, but most are.

The landlord is required to provide you with a copy of your lease agreement. So you should be able to get that from him within several business days. However, as long as the landlord provided you with a copy originally, he has met the requirement by law. You do still have right to request another copy at your expense.

You have many options to help protect your renters rights. You can always file a complaint through the RPA Mediation center, this would assign an agent to work directly with you and your landlord to come to some type of agreement. As for your fear of calling or contacting your landlord about other repair issues… Once you file a complaint via the RPA, you are federally protected against landlord retaliation for 6 months. If you need a repair done you can give your landlord a written request to repair the item. In the request you should give a timeline (like 3 days) and a clause stating that if the repairs are not made you will be paying for the repair yourself and deducting it from your rent.

No offense Joshua, but as a landlord it can get tiring to get calls about every little thing that goes wrong with your apartment. I’ve had people call me about reparing the dumbest things, and it makes me so mad. If you broke something don’t expect the landlord to fix it. Why don’t you list the things that you need fixed… this will help me understand if you really have a bad landlord or if you are too picky with everything.
