Charged for replacing worn out carpet

Hi,
I recently moved out of my apartment and have now got a notice from the management that they will be charging me to replace the carpet in the entire unit due to "matted and dirty in high traffic areas". Is it legal to do that?
I stayed in the apartment for 1.5 years and vacuumed regularly, but admittedly some portions of the carpet were more worn out due to heavier traffic. I’m not sure if the entire carpet needs to be replaced for this reason. What are the questions I should ask the management to make sure they are charging me correctly? They have charged me $538 for the entire one-bedroom unit.

In order for your landlord to charge you for carpet replacement they will need to prove that the damage was beyond normal wear and tear. Some states place the burden of proof on the renter. So depending on that you may have to prove that the damage was nothing more than normal wear and tear. Your best option is to file a apartment complaint with the RPA. They will be able to document the problem and hopefully get the landlord to come to fair terms. |

It sounds like you are being charged for carpet replacement when you shouldn’t be. Did you take any pictures of the carpet before you moved? |

Thanks for the responses. I do have some pictures, though I only took a couple. I’d tend to believe that the carpet could surely be cleaned by professional cleaners…I was really not expecting them to say that they need to replace the carpet, that too for the entire apartment! Would anyone know the approx cost of a new carpet for a 700 sq foot apt? Are they trying to charge me for the entire amount, without considering any depreciation on the existing carpet? Hello, I just put new carpet in our House and the price seems to be fair, considering a sf is about $2, plus $ 200 Installation and another $100 to remove the old carpet. Fair if you own. But this is not the right Way to calculate. Most Landlords calculate for exemple: Let’s say the carpet cost $1000 and should stay 10 years. So important is to find out, how old was the carpet as you moved in. And the calculate it down. It’s unfair as most professional Carpet cleaner cost about $100 to clean a high traffic area, and even the floor will come up again. Anyhow good luck! Best wishes for your future! |
