can i dispute my security deposit if i break my lease?

I have rented from Vintage Homes in Tyler texas. I beleive i have been cheated out of my security deposit. I did break my lease but i spoke with my landlord before i sent my 30 day notification, she agreed to return our full security deposit if the place was clean and rent was paid up through the month that the 30 days included. i did everything the lease and landlord said to do, cleaned and assisted in reletting the place. I paid the early termination fee and on the reletting fee agreement paragraph two stated that the renters WANTED to return in full the security deposit. Less then 30 days after i moved out i recieved a letter stating i was not going to recieve any of the security deposit back, because there was a 50% loss due to the early termination of the lease. The remaining security deposit was being used to exterminate for flees because it was infested with flees. There was a pet deposit for both animals paid at the time of lease signing. I have records of flee medication depliting the possibility of flee infestation. Do i have a case? Should i try to get my deposit returned?

Hmmmm it seems so confusing. By the way, do you have any written information wherein the landlord says okay and that they will return you deposit? Its really hard to prove your case because you broke the lease early and should have written consent from the landlord. This way you can support your case against them. But still you may still try to file a complaint in RPA. |
