Broken A/C prorated rent acceptable?

My air conditioner was out for several days a few weeks ago, when I paid my rent I deducted the days I wasn’t able to stay in my apartment due to unlivable conditions. My landlord didn’t see this as justified is there any law protecting me in this matter?

It must be very hot in your apartment but as always, you have to check your lease and refer to what it says. Remember that the lease, once signed, becomes a legal agreement. So what does it say about the broken A/C? Does it say that the landlord will have to pay for its repair? If it does then the landlord should. Sometimes, the lease may say that you pay for the repair. Sometimes, it would also say that you pay for the repair first and then the landlord will just refund you by prorating your rent. So what does it say? At all times, you must first consult with your landlord because just deciding that you will prorate the rent because your A/C broken might get you into a disagreement with him. If you have already informed him previously that your A/C was broken and he didn’t act on it, then you file for a complaint. |
