BATHROOM REPAIR ISSUES

We live in a two-storey apartment on 21^st Street in Kenilworth, NJ. The tenant upstairs would be moving out at the end of August. Our landlord wants to make bathroom repairs on both the apartment upstairs and ours even though we are not requesting for it. His reason:  he’s got a huge water bill. Our bathroom is functional, and, if anything, would only require aesthetic/cosmetic touch ups. He informed us that the repairs would be done simultaneously on both apartments for about two weeks once the one upstairs is vacated. He also told us that during that period, we can use his other rental on 12^th Street if we need to use the bathroom.  Can you imagine how inconvenient that would be for all five of us?  We think this might be a ploy to have an excuse not to return our security deposit when the time comes for us to leave. He has been notorious for not giving back deposits to previous tenants. Besides, we are not comfortable in having him and his workers come to the house when all of us are either at work or in school. What can we do?
