Attacks/break-ins/attempted rape – can we break lease?

By vanessa

We’re growing more and more disenchanted with this apartment complex even though it looks great from the outside, which is why we moved here in the first place. Our lease expires Oct 2011 but we want to leave much sooner. We wanted to know if these reasons would be LEGALLY SOUND causes for breaking the lease agreement:

Recently there have been a series of break-ins and attempted break-ins. Right around this same time a woman was attacked and almost raped at the CLUB HOUSE gym!!! We have repeatedly asked what’s going on with this – are they doing anything to provide security? Any information if the matter has been taken care of? What should we be looking for? How can we protect ourselves? Their ONLY answer is – if you want to know something call the local police department and get your own report on the incidents. Really? You can’t even so much as print up a little paper and put it in everyone’s mail box to tell them that there have been some "suspecious activities" and to please use the following suggestions to increase your safety… blah blah?
Point is – they KNOW that THIS complex has been hit SEVERAL times by break-ins and attackers and they are knowingly and willfully not informing their renters that there is/was a problem or how to ensure their safety. Because they’re providing an unsafe environment can we break the lease without recourse?
Thanks for the help – like I said, we want out ASAP so any immediate responses would be helpful.

unfortunately this would not be clause to break a lease, at least not in Ohio. Unless the landlord explicity told you in writing they were providing safe and secure conditions at all times you don’t have much of a case. A typical response on the landlords part usually would be that no one can protect your safety except you, unsafe things can happen anywhere, which is true, but you should definitely do things to help secure yourself ecspeially in the evening hours, parking by lighted areas, walking with your keys in hand, ect..
