A/C doesnt work – Landlord doesnt respond

Hi,
I m in Newark, Delaware. I have rented an apartment at "Cavalier Country Club Apts".
My a/c stopped working 2 days after i moved in. The temperature is about 100 degrees and even after 60 hours they wont fix it. They also pre-emptively told us that as per Delaware Law, A/C doesnt require a emegency fix and they would take their time.
Can i do something about it?

Your landlord is right in the fact that A/C is not required, thus they don’t have to immediately fix it. 60 hours is probably not considered unreasonable… If it had been over a week you would have more cause for action. If your landlord fails to fix the AC within a reasonable timeframe you can have it repaired yourself and charge it against your rent. —– Sample of how to write a letter to your landlord—- Furthermore it should be noted that allow the State does not mandate Air Conditioners, it was part of my rental contract; thus not fixing the AC within a reasonable timeframe will be considered breach of contract and liable for further legal action. I hope that helps. Also, you always have the right to file a formal landlord tenant complaint with the RPA. |
