property manager advice

I have been renting my primary residence in GA since 2007, when I moved to Dallas. Since 2008, I hired a realtor to become a property manager and we have been getting along quite well up until Q3 of last year.

Our agreement was that he manages the property in exchange for 10% of the monthly rent.

The mechanics of this has been the tenants mail him a cheque addressed to me. He forwards that on and I mail him a cheque for 10% of the amount.

Last October, he informed me that he wanted to change the agreement so that the tenants write a cheque in his name which he will cash, he will then send me a cheque for 90% of the rent. I did not approve of this as it did not offer any value and he expressed frustration becuase he was not being paid in a timely manor.

We argued because he gets paid as soon as I get paid so if there is a dalay, it’s becuause he does not send me the cheque on time.

Since then, he’s been devicive and exposing a lot of these issues to the tenents. first, he bypassed our agreement, and had them write a cheque directly to him which I put straight, then he had them write him a seperate cheque for his fees.

Today I got a call from a frustrated tenent who told me that he called them and asked them to make more changes and that they are tired of dealing with him.

I signed an agreement with him to manage the property and they signed a tenant landlord agreement with him on the property. I’ve tried to work with him but he’s becoming increasingly unreasonable, he’s no longer acting in my interest and he is putting my tenents at risk.

What can I do here that will not risk my tenants. I don’t mind getting into litigation with him but I do not want him to create problems for my tenants (damage to credit etc).

Advice would be gratefully appreciated.
