How to evict ex-husband from property

I have been divorced for the pass 4yrs and was awarded the sole owner of my home in FL. My ex refuse to move so I moved out. Since then, he has not paid the mortgage, nor maintain the property. The property is going to foreclosure and I do not want a foreclosure against my name so I have hired a Real Estate Broker to sell the property but he refuses to cooperate with myself and the agent and has just changed the locks on the door. What do I need to do to get him out of the property?
Please help this lost soul.

If the divorce is final you may have to file an unlawful detainer. Although you do not have a rental agreement with your ex husband he technically is considered a tenant depending on how long he has lived there. You may have to go thru the eviction process with the state your in. However since you or your agent has changed the locks on the door you may have opened yourself up to a unlawful eviction lawsuit. If you no longer own the building I would let the new owner or financial institution worry about it. If the house is in foreclosure and your going to lose it, why care?. He will eventually be charged with trespassing if he does not leave. Hope this helps. |
