Moving Expenses

What are moving expenses? Moving expenses by definition is the amount you spend when you move from one rental unit to another. Under normal circumstances, this expense is covered by the tenant.  So, when can moving expenses are shouldered by the landlord? In some states, there are laws saying that if the lease is terminated by the landlord due to reasons like, foreclosure or new tenant preferences the landlord is required to pay for moving expenses. The following are guidelines as to when a tenant can request for a full refund on moving expenses:

• Need a rental unit for their own use. If the landlord breaks the lease because he/she needs to use the unit for personal use. Then the tenant is entitled for moving expenses as well as a little bit more time to find a unit. Technically, with issues like this, the landlord breaking the lease doesn’t mean the tenant have any choice but to move? If there was a signed agreement, the tenant can choose not to move until the lease expires.
• Sell the unit and the new owner wants to move in. If the unit was sold and a new owner wants to move in, the tenant is left with nothing but to move. But, it still depends on the lease agreement because if an agreement is in place, even the new owners have to honor it or risk getting sued in court.
• The unit is deemed inhabitable after a maintenance issue. If the roof was leaking for a long period of time and it fell down on the tenant, they have to move. If it the problem was reported beforehand and the landlord took less action or did not do anything. The landlord can shoulder the expenses for moving out. If the problem was there and the landlord was not notified in anyway, the tenant is responsible for paying the cost of the damage plus the expenses of moving.
