eviction on record

My fiance and I are looking to rent an apartment in the Houston area.  He has an eviction that was 5-6 years ago from an apartment.  He had taken a combination of prescribed medications that resulted in him leaving his blinds open but undressing completely before going to sleep on the couch.  Some kids saw him through the window and the police were called.  He was arrested and detained, but the charges were dismissed.  The apartment evicted him while he was in jail waiting for the dismissal of charges.

 Will he be able to rent an apartment again?  How long will this be on his record?  Do they look at this as a case by case situation? The apartment is income based, can’t make too much, can’t make too little, so there is a lot of paperwork to be filled out.  I’m not sure how intense the background check will be.

Evictions usually stay on record for 7 to 10 years. However, that would depend on the disposition of the case. Was a formal eviction process done? Was it officially recorded or settled beforehand? If it was never officially recorded in court, then the eviction will not show up in your records. However, if you have good credit record then there’s a way to still get that apartment because some landlords would consider it if one of you has a stellar credit score and if you can prove your ability to pay the monthly rent. With regard to the intensity of the background check, that would depend on your landlord. Some landlords would only check 5 years back while others won’t. Some would only look at the rental history and credit score while others would also run identity and criminal record checks. The only way to find out would be to ask a landlord directly.
