Renting a house that the owner has passed away. The successor trustee of her estate has been telling me all along that she was working on saving the house and that I have nothing to worry about. I have been paying her faithfully every month on time, believeing that she was working to keep the house. I just recently received a letter from the HOA demanding that I pay them the rent money. She told me her lawyer said NOT TO pay them they were working it out. I just got served papers sueing me for eviction. I have 5 days. I have no idea what to do. I don’t see how they can come after me for her failure to pay them. They also sent me a 2 page break down of the dues, fees, late payments and lawyer fees totaling almost $11,000.00. If the money is not payed they are going to put a lein on the house in 45 days. Also. in the forclosure papers when the HOA got served from the bank, they failed to responed. The clerk of the court entered a default on the HOA. To me this means, the HOA has no claim on the house now. I am not a lawyer so I don’t know for sure. I have since learned that the trustee is NOT going to save the house. She is not going to pay the HOA $11,000.00. What I think I know is in the next couple of months or sooner, I’m going to have to move. I didn’t pay the landlord Sept. rent. She is now telling me to send her the rent and she will take care of the HOA. I don’t believe her. I read the HOA’s bi-laws cover to cover twice. It clearly states the the owner (who holds title), is responseable for all dues, fees ect. My thought is to pay no one and to save as much money as I can to find another house and move. This rent payment is $1000.00 a month. The landlord has pocketed $30.000.00 of my money and not payed a dime to anyone.
How is this possible?? How can the HOA evict someone from a house?????
