Lease liabilitiy

I’m hoping to move into a townhouse with 2 other friends. One of my friends and I are both military and expecting orders to our first assigment sometime in the next year. The third friend is a civilian. Under the Servicemember’s Civil Relief Act, we can get out of the lease without penalty when we receive orders, but what would happen to our civilian friend? I’m trying to find our whether or not when we get orders it will end the entire lease or just our portion and then my civilian friend would be responsible for paying rent for the entire place or subleasing. Thanks in advance for any advice.

Hmmmm… this is a little difficult. Well, lets start with your daughter. Since your daughter’s name is in the lease, she has equal rights to the room. Now, since the lease is for three people, if someone wants to replace, that person has to sign the contract. If not she can bring her concern to the landlord for resolution. If the other girl wont sign then your daughter keeps her room until the lease is over. For repairs, it depends on the lease you signed, also if you were the one who destroyed the property then you will pay for it. However if you have a lease that states the owner will be the one to handle the repairs, then you can file a complaints. As for the beg bug infection, yes you can break the lease early. As stated in the law, a property must be habitable for it to be leased. If your landlord did not resolved the issue then you can break the lease. |
