Mold Problem

WE live in a house in pennsylvania and ever since Hurricane Irene came through we noticed a water leak which in turn has formed BLACK MOLD. We have contacted the landlord about this issue and she says she will replace the windows but will not address the mold issue because the house is 120 years old. My question is what are our rights? Do we stop paying rent until the problem is resolved? Is there an attourney we can contact? Any help will be greatly appreciated. We have done 4 mold tests and it is airbourne and recently we have been getting sick even with living on the first floor and the mold is on the second floor and in the attic.

Mold Problem

Hi, recently my girlfriend and I chose to move in with one another. We chose a basement unit in a condomineum complex(its more like an apartment building.) Since we have moved into the apartment we have both been having allergies that are slowly growing worse, niether of us have had allergies before in our lives. The ceiling in the bathroom has begun to yellow however their was no visible mold. We decided to do a mold air test and within 48 hours we had mold growing in the test kit and we expect the mold is growing above the ceiling in between units. The whole ceiling would have to be removed and replaced to guarantee their is no mold. We have alerted our Landlord to the problem but we have just entered our second month and feel this is absurd and must have been a problem for the last tenant. We would like to either end our lease somehow or be placed into a motel until the mold can be addressed. We were wondering if there was a process or a legal way to get out of the lease or get into a hotel for the time being provided by the landlord. If those options are not possible also I was wondering if proffessional mold removal company should be used to remove the mold. Thank you very much

Hey Mike, I am in the same situation as you are right now. My boyfriend and I are actually going to court this wednesday and suing our landlord due to the mold issue we’ve had in our basement apartment as well. We had mold growing in our shower above our heads as we took a shower and mold under our queen size bed that was growing in the carpeting as wide and long as a queen size bed (it was disgusting!) we also had mold growing in out living room under our couch and ottoman. We had to throw everything out and buy all brand new things when we moved out. We are now going to court on wednesday to sue our landlord for all the trouble he has caused us living and breathing it in. All the presonal property that we ahave lost and for our security deposit he will not return and for our last months rent as well. Mold is not a fun thing. I’m 23 years old and have had to take off of school this fall semester just to replace all of my belongings with working overtime serving and bartending. Good Luck! Look up Conventional eviction. Thats what we had to do! |
