Must I Pay next months rent?
By Hannah
We had a year lease which ended several months ago. We are renting month to month now. In our lease agreement it says that if we leave after the lease is up and we are renting monthly that we must give thirty day notice. It also specifies that they do not prorate. If we give notice in the middle of the month we must till pay for the full next month’s rent. That’s fine.
However we just received notice (On Oct 22) that we had until Nov 31 to move out. No reason was stated and the rental agency said they would help us find a new place because we are good tenants that pay on time and keep the place in good condition.
The problem is that they say the 30 day notice on our part still applies. We want to move out before Nov 1 and avoid paying rent for Nov. Are we obligated to give notice if we have received notice that we must leave? Shouldn’t they have given us more time (like send us the notice in the beginning of the month?) they say we must pay in full for Nov regardless of when we move out…Is this right? We are hoping to move out by Oct 31. It seems shady that they can do this to us. By not giving us enough time to give notice for Oct they are basically forcing us to pay them rent for an entire month that we will not be there…
I thought there was a law that the landlord had to give 60 day notice?
