Rent late fee

By AJ

I received a bill from my apartment complex with a credit and paid it being sure to include the payment stub in the envelope this month.  The management co. is not trying to evict me unless I pay the difference between my regular rent and the amount on the bill plus a late fee.  What legal options do I have?  The rent late fee seems to be higher than it should be.  Can the landlord charge me a daily late rent fee?

You haven’t made it real clear as to what this credit is for. If they owed you a credit, then yes, you have right to not pay it. However, if they made a mistake in their billing and you thought of it as a surprise bonus, then you still need to pay it. Unless the amount is for something you are owed, management has the right to collect it from you.
