We received an 90 eviction notice

In December of 2009 my roof started leaking, and my floor was caving in. We asked the landlord to repair the problems. He told us that we had to do it our selve’s. We informed him that it was his responsibility to do so. time passed and we received an 90 eviction notice. We called him to ask why was we getting evicted in which we pay our rent on time every month which was a month to month agreement. He told us in order to honor our request for repairs, we would have to get out. He then offered us to move into another one of his properties in which was alot more than what we were paying. He had been trying to raise our rent for some time, but could not because we were grandfather in when he bought the property. We asked him again if we could stay, he stood firm on his eviction, which was March 1,2010. So we moved out on February 1,2010. Now he is suing for the month of February, the same month we moved out of his property, and he never gave us back our security deposit.

To get security deposits when lease is near to end or ended, is quite a hectic problem for tenants because of landlords conditions and harrassments, If you are renting month-to-month, or if you
began your tenancy with a lease that has
expired and you are now renting month–to month, the new owner must give you at least
90 days’ notice before evicting you. In the
event of a foreclosure, this Federal law
overrides Washington State law, I don’t know about which state you are in, which allows
a landlord to terminate your month-to-month
tenancy with just a 20-day notice. Now I suppose that you have paid him Jan payment, and also you could have stayed till Feb 2010 maybe half month or more than that. If your landlord is adament and not ready to give your deposit, file a complaint. This site has a good feature of filing a complaint is landlord is not giving you your security deposit, They assigned a property mediator immediately once you file a complaint, and i just now saw that the filing charge is less 35$. http://www.rentalprotectionagency.com/complaint_center.php
