Can my landord do this?????????????

I have been living in the same apartment complex since 2004, moved 3 times, I moved to my 3rd apt last year in the same complex of 2009 June. I never had a problem. This summer there were known facts that other buildings in the same complex had bed bug infestations and September I fell a victum to this. I immediately contacted management and they scheduled pest control a week later to treat the problem 3 times. The critters were isolated just in my living room and nowhere else. At the time of me notifying management of this issue I was never told I would be responsible for the charge. This day Oct 28,I received a notice charging me 300.00 and to pay with my November 1st rent giving me only 4 days to come up with 300.00 dollars extra. I signed a 12 month renewal lease just last week to start Dec 1 since my 12 month rental ends Nov 31, 2010. I haven’t rec’d confirmation yet on this. My question is: Since they never told me I would be responsible for the pest control charge, can they just spring this on me in such short time and waiting 1 mth to notify me? I think they are doing this because if I don’t pay this 300. due with rent Nov 1, that they won’t renew another year contract.
I think that these pests were in my apartment before I moved in. I haven’t been staying in any hotels or sleeping anywhere other than my apartment. August 2010, pest control came out and treated apartments across the hallways of my building and not our side. Since then 5 tenants have moved out. When I asked Management about what they were spraying for they stated it was for earwigs. Gee I wonder? Yeh right?

They definitely cannot do that to you. File a complaint with the RPA. |
