Landlord did not disclose auto renewal rate

I’m a renter, and my lease is ending on 10/31/2010. I called my property manager because I’ve not yet received any disclosure about new rates for the new lease nor month-to-month rates if my lease automatically renews. So I called my property manager to confirm that my rent was staying the same. But my property manager told me that my rent would be increasing, which was not acceptable to me. I gave notice that I would be leaving the property on the last day of my lease. The property manager told me that I have 60 days notice and that I had to stay until 11/30/2010. But she told me that I would have to pay a month-to-month rate for November of 1200 dollars (I only pay 770 under my current lease). I checked my lease and it states that I have to give a 60 day move out notice and that if my lease auto renews, I have to pay 100 dollars over the market rate. I was never sent any information about renewing nor about how much this was going to cost me if i missed the 60 day notice period. Is this legal? They market the apartments for 745 according to the property’s website. Can they really charge me 1200 for November? Please help. I’m a single mom, and I just don’t know where I’ll come up with the 430 dollar difference.

Your property manager is most definitely taking advantage of the situation. The best defense is to take a public action against them. I would suggest you file a complaint with the RPA. Raising the rent from $770 to $1200 is ridiculous! The only real way to fight it is to make it public. I’m sure your manager will quickly change the amount to something more reasonable or back to the $100 as stated in the lease. I can’t believe your landlord is being so unethical with you. What a jerk! Don’t worry, the RPA I’m sure will help you with this. As a landlord when I get formal complaints I do everything in my power to resolve them fairly even if that means that I have to lose some money to protect my public image. Don’t let your landlord take advantage of your situation.
