Successor landlord wont return my security deposit!

The apartment building in which I was living was foreclosed earlier this year. The successor landlords did everything legally required of them, such as notifying me in writing that the lease was performed month-to-month etc. Now that I’ve moved out, theyre telling me to ask my old landlord for my security deposit back. However, according to Ohio’s legal code 5321.20, the former landlord should have forwarded all security deposits to the successor landlord. Thats also the section that deals with informing me in writing of the conversion of my old lease into a month-to-month. The landlords abided by all the other requirements in the code, so it would seem they or their lawyer are aware that they had to get the security deposit from the old landlord. But are they right? Should I ask my old landlord or are they supposed to pay? If they dont, should I get a lawyer?

Talk to the landlord and try to get it fix without spending another dime. You might want to review your lease agreement too. For more help. Just like what I did. I filed a complaint through RPA. It’s an option for you too. |
