Apt Managent Charging $1000 plus for Bed Bug Infesation After Vacating

Dear Sir / Madam

We (my Wife, 4 Year Son and myself) Lived in Apt#220 of (Sonterra Apartments, 17440 N Tatum Blvd, Apt#220, Phoenix , AZ, 85032) close to 4 years staring from Aug 2006. We vacated the apartments on May 30th Morning , as planned and agreed with Apartment Management

1. We went abroad and came back and currently staying with a friend, before taking new apartments

2. Sonterra Apartments Management always insisted that they would do inspection only after vacating. Since I was going abroad I couldn’t go they when they inspected after my vacating the apt.

3. I made sure I have cleanning all the apt (inspite of living there for 4 years) to my best abd handed over everything properly

4. Recently I received a checklist from them stating the results of inspection, out of which certain things are totally shocking

5. They deducted all my security deposte $500 for all miscl repair, In addition they have charged $1000 plus as loss of 1 month rent due to  Bed Bug Infestation.

6. I was very surpised as we didnot face any issues with bed bugs atleast in the last six months and even before leaving

7. I have vacated on 30th May Early Morning and They Have inspected on 3rd June 2010.

8. Now they are demanding that i should pay one month rent before july 25th, (over and above security deposite) as penalty due to delay in renting for one month due to bedbugs

9. During our stay right from 1st Month of Entering Apartments, we faced with peculiar bytes (every year in once particvular time) and we asked aprtment management to disinfect . They did on our request every year. They called it as invisible bugs (not bed bugs). Now Suddenly where did this bed bugs come out, is the Big Question

I request you to please advise me the future course of action, as I feel the Apt Management is just trying to throw bblame at me , as i have vacated and showing some discrimination. Becuase when 2 of my fiends vacated same apartments without cleaning any thing they were charged $200 as whole , by the same management.

I request you to kindly help me the next course of action.

Hi Ravindranath,

Since you had bedbugs, you do have right to fight your landlord on those charges. Bedbugs are most often the responsibility of the landlord, so if you had bedbugs– you should be able to get them to remove those charges.

Even the other charges can be disputed. The best affordable option would be to file a complaint with the RPA. Here is a link to file a complaint: https://www.rentalprotectionagency.com/complaint_center_form.php

To get legal help through the Rental Protection Agency you will need to be aware of the following fees:

1) RPA Filing Fee ($35)
2) Certified Case Upgrade ($18) This is optional, but a must for your situation.
3) Official Bonded Case Copy ($9) This is option, but helpful for official documentation.

You’ve got some options, but the most effective and lowest legal option is the complaint option stated above. After you file a complaint an Agent will be assigned to your case. The Agent will take care of resolving your case.

i lived in that complex for almost three years i am facing the same situation, i will fight this and they would not get a penny from me i paid all due to them and i cleaned my apartment before moving out 1000 dollar to clean carpet very funny.
