Court fees

Ok so my apartment complex is trying to charge me for court fees. I would be ok with it, but the problem is I NEVER HAD TO GO TO COURT. I think they are trying to get over on me because this is my first apartment and I am young. Granted my rent was late, but I PAID the RENT and LATE FEE before the court date. How can they charge me for court fees?  I gave them the exact amount that was on my court complaint letter that was sent to me. This happened to me once before in the beginning of my lease and I apdi the rent plus the late fee before the court  date and the didnt charge me court fees so why are they trying to charge them to me now? Can someone please explain this to me.

Hi JC :)
Congrats on getting your first rental unit. It can be frustrating when things like this happen, however, it can be avoidable. Just because you paid your rent late does not exactly mean that you owe any other fees beyond the late fee and penalty you already paid.
This may be something that an RPA Agent can help you with. I would consider going through their complaint system. At least that way you would know that your rights are being met. If the fees can be waived or non-valid, I’m sure they would know.

I found the link to get help from the RPA. It looks like you will need to file a complaint– http://www.rentalprotectionagency.com/html_apartment_landlord_complaint_help.html
it will cost you $35 in filing fees, but surely worth it. By the way, I was reading that once you file you are protected against landlord retaliation. So, really, that makes the most sense.

It may have been they had to pay a fee for filing in court and that may be the charge you are receiving. But, it couldn’t hurt to have someone look into it. You can ask the apartments for a break down of the fees and receipts etc. too, just to make sure it is valid. You can probably file w/ RPA and make life a lot easier though.
