Mold in House

We moved into a house in October to find out it had mold growing in the bathroom, our bedroom and probably other places. My husband, kids and myself all became very sick right after moving in. My husband was really sick, seeing a dr. almost once a week and I ended up in the ER. We have since moved out and my husband is much better but I am still dealing with weakness. We had to throw away some of our things due to the mold. Our question is, do we have a right to ask for restitution from our landlord for our lost items and medical bills. We are also concerned she will rent it again. Thanks

Yes, you are definitely able to try to get restitution for the medical bills and for the items you had to get rid of – as long as you have receipts and as long as your doctor says that the illnesses were due to the mold. In my state, if you sign a lease and later find out the property is inhabitable, the landlord has to pay for a new place for you to live until the place is habitable again. If I were you, I’d report your former landlord to the department of health and HUD. |

I think yes your landlord should be responsible for that and if ever he still wants to rent that house he should first clean from molds. The people renting his house should be his top priority. |
