Whom should I ask for security deposit refund?

I recently moved out of an apartment located in Arkansas.  I signed my initial rental lease a little over five years ago.  I agreed to pay a higher rent in order to have a lease that was month to month.  My security deposit was $350 when I signed my lease.  After about three years my landlord lost the apartments to the bank.  My new landlord purchased the apartments from the bank and agreed to let me continue my month to month lease since I had been such a good renter.  Everything went fine until I moved out a couple of weeks ago.  I cleaned the apartment and the landlord even said that he wished all renters would leave a place looking as good as mine did.  He couldn’t believe it was in such good condition after five years.  Well, that was fine up until the point I requested security deposit refund.  My current landlord said that I had paid my deposit to the previous landlord and that I would have to get it back from him.  My previous landlord stated that he no longer owns the apartments and doesn’t have any intention of giving me my $350.  Does anyone know who is responsible for the deposit?  I would like to get this money back if it is possible.  Thanks in advance for any help you can give me.

Kenneth, do you have a copy of the original agreement you signed with the first owner? If you do and you can show that the previous owner had the deposit of $350, then it would be the responsibility of the new landlord to return that. Any time a property is sold, the new owner is held to the terms set forth by the original agreement.

That same crap happened to me! I was actually able to get me deposit back after fighting with the new landlord. They finally agreed to return it. If you have more problems you may want to consider filing a complaint, the RPA should be able to demand a prompt return of your deposit.

Hello Kenneth! Why even mess with your landlord?! The law requires landlords to return deposits within a certain time-frame… varies per state. But most require deposits to be returned within a couple weeks to 30 days. I say, get an attorney… or file a complaint with the RPA.

GET EVEN!!! I WOULD IMMEDIATELY LEAVE NEGATIVE FEEDBACK FOR YOUR LANDLORD. YOU CAN PULL THEIR REPORT THROUGH THIS SITE, THEN LEAVE YOUR NEGATIVE FEEDBACK BY CLICKING ON THE “ADD COMMENTS” SECTION. IF YOUR LANDLORD IS MAKING A BIG DEAL OVER A DEPOSIT, YOU SHOULD MAKE A BIG DEAL ABOUT HOW AWFUL YOU HAVE BEEN TREATED. I ALWAYS CHECK THE LANDLORD RISK REPORT… IF I SEE IT’S BAD, I FIND A DIFFERENT RENTAL… ITS NOT WORTH IT!!! I WOULD LIKE TO KNOW WHO YOUR LANDLORD IS, THAT WAY I NEVER RENT FROM THEM.. GOOD LUCK! ITS PAYBACK TIME!

I was just looking around this site, and noticed that your deposit problems seems to be a common complaint handled by the RPA. Have you thought about filing a complaint? You would think that filing a complaint would make things happen. Wouldn’t the RPA know the best way to help you? Just a thought, sorry wish I had real advice, but if it were me I would see if they can help.
