Problems with rental increase notification

By Rhiannon Kindle

MY landlords notified me 12/31/2010 that my rent would be raised, and are saying that on 01/01/2011 I would have to pay the increased rent.  According to the law I had to be notified within 30 days, and was not.  They are now saying they put a note on my door on 11/08/2010 notifying me but I never received this.  Can they do that?  Does it have to be given in person or mailed?  Can they just say they put it in my door?

A notice of rent increase need to be mailed out to ensure that you will get it. It cannot be given verbally and it cannot be just left on the door. It works like the 3-day notices, 30-day notices and so on. Basically, every formal communication between the landlord and the tenant must be mailed for documentation purposes. I think what your landlord did is not right. Why don’t you file a formal complaint against him? The RPA has a complaint center on site.
