problem with city inspector

I have a 5 bedroom apt It consists of a 2nd and 3rd floor . there are 3 of the bedrooms on the 3rd floor . that is all that is on that floor . kitchen and bathroom are on 2nd floor . house was built that way 140 years ago . there is one way up to 3rd floor and one way down . those bedrooms are sleeping quarters only . fire marshal says its legal . LCI from city says its not . this is in new haven ct . whos right . is it legal .
