Lease conflict.

I just want to get feedback from what you think about the situation I am in. Whether it be advice, suggestions or even critiques.

I moved into my current place Aug 1, 2010 and I signed a lease which stated. One adult only and that I am to not have any persons or guests staying longer than 2 nights in a 30 day period. Without having written approval from the landlord and any time that exceeds that 2 nights requires a $60 surcharge in advance. Fine so screw me for not reading the fine print.

I understand the concern the landlord has since he is trying to protect his property and he has the right to impose these rules. But now my brother who is a minor and my mother recently went to court and it was mandated that they cannot live under the same roof so since my brother needed a place to stay I offered mine. This is a temporary arrangement 3 weeks or until the next court date. He goes to school 50 miles away and I have been taking him and picking him up from school while trying to schedule this around my full time work schedule. And lo and behold I get a very hateful email stating that I have been duly notified that I am not withholding my end of the lease. And if I don’t comply then the next action to be taken is eviction. Which according to the lease if he evicts me then I am responsible for making my rental payments until the lease expires which is Aug 1, 2011. And he also wants me to pay the $60 a night surcharge for my brother staying with me.

I informed my landlord of the recent developments and that it was not my choice to be in this situation. Yet I will NOT turn my own sibling away. I plan on meeting with him today to give him my 30 day noitce to vacate. But since I am under a lease is that still considered breaking it? Then will I not get ANY of my deposit back? I am also worried that he will evict me because in the email he stated that he has been in a similiar situation in the past and he has gone to court and won the case.

I just want to move out, get my deposit back and never look back. I mean my brother is homeless, my mom is in trouble with the law. I don’t really need the scrooge of all landlords evicting me and requiring that I still pay him rent until the lease expires in the middle of NEXT YEAR!

Hi, I dont see any issue with having your brother stay in your apartment. You said your lease stated that only one adult it allowed. Your brother is a minor not an adult so what’s the concern? If the lease used the word adult then it should be person at the age of 18.
