Landlord kept security deposit, without signed lease

A landlord kept my deposit and first months rent even though I never signed the lease, can he do this?  How do I get my security deposit back?  I refused to sign the lease because the property was not as he had describe it.

It should not be greater than one month rent

You should take a legal help. As you did not signed the lease, he cant hold your security deposit.
